Our Patent Attorney Masanori Hiroe will introduce an example case of a registered trademark in which the decisions made by the JPO were repeatedly overturned.

The convenience store chain Lawson filed a trademark application for “Genkotsu croquette (fist-sized croquette)”.  Although the examiner rejected the application, the decision was successfully appealed.

An interested party later filed a request for invalidation trial of the registered trademark. Even though the trial examiner decided that the registered trademark was valid, the Intellectual Property High Court withdrew the decision and finally deemed the registered trademark as invalid.

Mr. Hiroe will give a lecture for beginners on the details of this case and whether Lawson will be able to keep using the trademark “Genkotsu croquette”.
