Under Japanese IP practice, design applications that have lost novelty can still be registered in case the Japan Patent Office applies an exception to loss of novelty. In this month’s lecture, our patent attorney Masanori Hiroe will present a ruling made by the Intellectual Property High Court, which concerned the validity of the JPO’s decision to reject application of exception to loss of novelty and invalidate a design registration.

 

Mr. Hiroe will explain for beginners the requirements for applying exception to loss of novelty and what evidence is required.
